Fill out Form I-765 for Employment Authorization Document (EAD) for legal employment in the United States. The USCIS has updated its Form I-765, Application for Employment Authorization with a new version.  U.S. Citizenship and Immigration Services (USCIS) uses the Form I-765 to apply for an employment authorization document (EAD) if the person is an eligible alien and the EAD will be valid for at least one year and has applied for an initial grant of assistance.

If you are a foreign national who is not a US citizens and will be in the United States temporarily as a nonimmigrant, then you can file this form to request employment authorization. Form I-765 is an application for employment authorization by a temporary worker. You must file Form I-765 if you are applying for an extension of stay or change from one nonimmigrant classification to another, such as from the H-1B nonimmigrant classification to the employment-based first preference category or from J-2 nonimmigrant classification to F-1 student classification.

You can file Form I-765, Application for Employment Authorization, at any time while you’re waiting for a decision on your application. If USCIS hasn’t already started field processing your case and you don’t have a receipt notice as proof of your application, you must send us the Form I-765 along with the correct fee before we begin reviewing your application. To apply for employment authorization while your other application is pending, you will need to complete parts 1 and 2 of this form, or parts 1 through 4 if submitting the fee by mail. Part 3 can be completed later when you are legally authorized to work in the United States.
